As a Paxil Birth Defect Lawyer, I keep a watchful eye on drug recall news. Lately I have been following the cases against GlaxoSmithKline for their mistakes in the manufacture of several drugs. The prescription drug that is the focus of the court cases is for the antidepressant Paxil.
In October, court proceedings exposed that GlaxoSmithKline made a mistake while producing the medication in their Cidra, Puerto Rico plant. The federal government and several state governments have filed drug adulteration claims after the mistake was made public by a whistleblower. According to this person, the mistakes on the production line made some of the Paxil pills extremely dangerous. Some drugs off of the line only had the inactive ingredient and some pills had only the active ingredient.
A subsidiary of GSK, SB Pharmaco, pleaded guilty to the federal charges of drug adulteration. According to the U.S. Department of Justice, GSK will pay $150 million in fines for the criminal charges and $600 million in penalties on a civil level. GlaxoSmithKline also faces several civil lawsuits. The most recent case awarded the State of Washington $6 million for their case against the drug company. The state plans to fund its Medicaid program and pay the federal government back for the state's share of prescription costs of the Medicaid program.
Paxil has been surrounded by many complications, and it is important that patients should see a doctor right away. If you are taking the prescription Paxil, you should be tested to see if you are receiving the correct dosage. If you have been a victim due to a drug company's negligence, please contact an experienced Missouri product liability attorney right away. As a Missouri personal injury attorney,
I have many potential clients ask me "how much does a personal injury
lawyer cost?" Personal injury attorneys typically take on cases with a
contingency fee agreement. This type of agreement allows an attorney to
pay all the costs required to research the injury, speak to
professionals, and file the personal injury claim. Instead of having the
client pay thousands of dollars up-front, the attorney advances the
costs of the case and gets paid when a settlement is reached.
In Missouri, personal injury attorneys will charge anywhere from
33.3% to 40% in attorneys fees for personal injury claims. It is
important to realize when hiring an attorney that he or she will only
collect attorney's fees if you receive a settlement. The attorney
assumes all the financial risk of a personal injury claim, which
motivates them to work hard to win your case. If your attorney is not
returning calls or you feel he or she is not handling your personal
injury claim appropriately, you have the right by Missouri law to
terminate your attorney. If you do terminate your attorney, he or she
may put an attorneys' lien on your case for reimbursement for the hours
and money spent on your case up to termination. A judge will have the
final approval of the amount the attorney is allowed to charge a former
client.
You only get one shot at collecting for your personal injury lawsuit.
Many people hire the first Missouri injury lawyer that they speak to
and end up unhappy with their services after it is too late. You and
your attorney will spend a lot of time speaking during the course of a
personal injury lawsuit, so it is important that you feel comfortable
and know that he or she has your best interest in mind. Once you see how
hard your attorney works on your personal injury claim, you'll
understand why it is worth 33.3% for them to fight for you. Our Missouri
personal injury attorneys work hard for their clients and will work
hard for you. Call 888.956.2487 for a free consultation with one of our
experienced personal injury attorneys today.

When you turn on
your television and see a commercial that announces a recall, you won't pay
much attention if it does not affect you. But what if the recall does affect
you? What do you do? That's what over 100,000 people are asking themselves with
the DePuy hip recall that Johnson & Johnson issued in late August. As a
product recall attorney, I have kept a watchful eye on the recall so that I can
keep the public updated from a legal standpoint.
Johnson &
Johnson's DePuy Orthopedic division also recalled its ASR XL Acetabular Head
System along with its Hip Resurfacing System on August 26, 2010. First
manufactured in 2003, DePuy's ASR Hip Resurfacing System became a popular
choice within the medical community. Following the August recall, a motion to
consolidate all federal court litigation regarding the product was filed. A
meeting is set for November 18, 2010 in North Carolina to centralize the
product liability lawsuit.
A little over a
month after the company issued the recall, calls flooded doctors offices around
the country asking for more information on the hip recall. The doctors were
overwhelmed by the recall announcement because DePuy did not keep a record of
the patients that received the ASR hip, so the company was unable to contact
each recipient directly. DePuy admitted its recordkeeping mistake from the
beginning, but that does make it any easier to track down the patients that
need to be warned of the risks.
Johnson &
Johnson has had 11 recalls in the last year. This amount of recalls is the
result of a company that takes short cuts because they are focusing more on
profits than the safety of consumers. Johnson & Johnson admits that they
have lost their way, which is a step in the right direction. Regardless of
Johnson & Johnson's desire to put the recall behind them, there are still
several thousands of people in the United States who are not aware they are at
risk. If you had a hip replacement done between 2003 and 2010, please contact
your doctor to find out if you are at risk from the hip replacement. Your next
step is to hire an experienced personal injury attorney to fight for you.

A dog is supposed to be man's best friend, but sometimes
they can be dangerous too. Dogs have been domesticated for centuries, but in
the last several years there have been numerous reports of dogs attacking
people. As a Missouri Dog Bite Lawyer, I have fought against many dog owners
who were liable for my client's dog bite injuries. Not all dogs are dangerous,
but it is the owner's responsibility to make sure their animal does not cause
harm to another person.
The story of an 84-year-old minister in Missouri who died as
a result of an animal attack recently caught my attention. Rev. John Reynolds
and his son, John Reynolds Jr., owned 17 pit bulls in Callaway County. Reynolds
Jr. found his father in the dog's pen severely injured from animal bites, which
he later died from. When the son arrived, 16 of the dogs were loose. One dog
did not leave the pen because it was also wounded from animal bites.
Rev. Reynolds loved his dogs and always insisted to his
family that the pit bulls had a calm nature. He was never concerned of his
safety when it came to his dogs. The Reverend's son does not believe that the
pit bulls are the cause of his father's death. He believes that a pack of stray
dogs or a mountain lion attacked the pit bulls and his father. Since the owner
of the property died from his injuries, no charges will be filed and the dogs
will remain on the property because the county can't handle that many dogs.
There are over 500,000 reports of a dog bite each year in
the United States and 12 reports of dog bite fatalities. In the event of a dog
bite, the owner of the dog could face a civil lawsuit because they are liable
for their animal. There are many factors in dog bite cases such as if the dog
was provoked, previous knowledge of the dog's aggressive behavior, or the
county where the bite took place. There is a statute of limitation on dog bite
cases that limits the amount of time to file a lawsuit. The statute of
limitations for a dog bite is 5 years, so please call an experienced St. Louis dog bite
attorney to help protect your rights as a victim. Call 888.956.2487 for a free
consultation to discuss your dog bite claim.

As drivers, we understand the risks associated with driving,
but often don't pay attention to the hazardous conditions on the road. As a
St. Louis Motorcycle Injury Attorney, I believe that I should make drivers aware of
road conditions that could potentially cause an accident. On a Missouri road,
it is common to see the black tar that lines the street. The black tar that
crosses the streets aren't really threatening to motorists in a passenger
vehicle, but they can be deadly for people riding a motorcycle.
The black tar lines can be potentially dangerous to
motorcyclists and lead to many fatal accidents. The concern for people driving
a motorcycle is that the black tar can become slick in wet or hot conditions.
Unlike passenger vehicles, motorcycles only have two wheels, so there isn't
much that can be done to compensate when conditions cause the driver to lose
traction.
Missouri roadways are susceptible to cracking because of the
winter temperatures and road crews use the tar to fill in the gaps so there are
not large holes in the road. Unfortunately, there is not enough money to
replace the cracked sections of the road after each winter, so the problem is
fixed with tar. The application of the tar directly effects how dangerous the
road will be afterward. If too much tar is left behind and not properly
scraped, it creates a larger area that can become slick. The mixture of the tar
is just as important as the application. If the solution is not made well, a
Missouri motorcycle accident is more likely to occur.
Unfortunately, there is no reliable data to illustrate the
motorcycle accidents that are caused by road conditions such as black tar
lines. Seasoned motorcyclists are aware of the hazards on the road because they
have been riding for many years. Beginners or inexperienced motorcyclists need
to be aware of these road hazards, so they can be prepared when they are
accelerating or braking near black tar lines.
Please use caution when on your motorcycle and be aware of
the risks. If you have been injured in an accident, please see a doctor for
your injuries and consult an experienced motorcycle accident attorney. Call
